What this site is

An informational website about Villacorta Capital LLC and the software we build. Nothing here is an offer to sell anything, and nothing here creates a contract between us beyond these terms.

Not financial, legal or investment advice

Some of what we build concerns money — most obviously Fintex, which teaches personal finance. Neither this website nor any of our apps provides financial, investment, tax or legal advice. We are not a registered investment adviser, broker-dealer, bank or financial institution, and we are not licensed to advise you on your particular situation.

Educational material describes how things generally work. It cannot know your circumstances, and it is not a substitute for a licensed professional who does. Despite the word "Capital" in our legal name, we do not manage money for anyone, we do not accept deposits or investments, and we do not offer securities.

Our intellectual property

The content of this site — text, layout, graphics, screenshots, the halftone artwork and the Villacorta Capital mark — belongs to Villacorta Capital LLC or is used with permission. You may read it, link to it, and quote reasonable portions with attribution. You may not copy the site wholesale, pass our work off as yours, or use our name or logo in a way that suggests we endorse you.

Product names such as Fintex, Alienville, Meet Me Halfway and HydroTrue identify our software.

The apps have their own terms

Our applications are distributed through the Apple App Store and Google Play and are governed by their own terms and privacy policies, plus the terms of whichever store you obtained them from. Nothing on this website changes those.

No warranty

This website is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that any information on it is complete or current. Products described as "in development" may change substantially or may never be released.

Limitation of liability

To the fullest extent permitted by law, Villacorta Capital LLC and anyone acting on its behalf will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of this website — whether the claim is based in contract, tort, negligence, strict liability or anything else, and even if we were told such damages were possible.

Where liability cannot lawfully be excluded, our total liability to you for all claims relating to this website is limited to one hundred United States dollars (US$100).

Some jurisdictions do not allow certain exclusions or limitations, so parts of the two paragraphs above may not apply to you. In that case they apply to the maximum extent the law allows.

Where we link somewhere else, we do not control that site and are not responsible for its content, accuracy or privacy practices.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising from them will be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the jurisdiction of those courts.

Language

This site is published in English and Spanish. If the two versions of these terms differ, the English version governs.

If part of this fails

If any provision is held unenforceable, the rest stays in force and the unenforceable part is applied as closely as the law permits to what it was meant to do.

Changes

We may update these terms. The date above shows when we last did. Continuing to use the site after a change means you accept the updated version.
